Los delitos de homicidio y lesiones imprudentes cometidos con vehículos a motor

Abstract

La reforma 1/2015, de 30 de marzo del Código Penal ha supuesto numerosas novedades en el ámbito del homicidio imprudente y de las lesiones cometidas por imprudencia. Por un lado, despenaliza los delitos leves derivándolos a la vía civil; y por otro lado crea la imprudencia menos grave, desconocida totalmente por el Derecho Español, la cual ha originado numerosos problemas de interpretación a la hora de delimitar el espacio de acción de la imprudencia grave con respecto de la menos grave, para lo cual es necesario con anterioridad hacer un estudio de la imprudencia. Ésta reforma ha tenido importantes repercusiones en el ámbito del tráfico rodado y la seguridad vial, modificando los delitos cometidos con vehículos a motor y sus penas, las cuales pueden ser agravadas según el número de víctimas lo que ha originado una serie de críticas, e introduciendo el delito de fuga del lugar del accidente.

The reform of the Organic Law 1/2015, 30 th of March, of the Penal Code has supposed numerous novelties in the field of criminal negligence homicides and injuries. On the one hand decriminalizes minor crimes deriving them to the civil route; and on the other hand has been removed the slight negligence unknown for the Spanish criminal law which in presenting a number of problems concerning interpretation when delimiting the space of action of gross negligence with respect the slight negligence for which it is necessary to do in a study of advance of the imprudence. This reform has been a special impact in the field of the road traffic and road safety, changing the crimes committed with motor vehicles and their penalties, which can be aggravated according to the number of victims which has caused a series of criticisms, and introducing the crime escaping from the scene of the accident.
