La Independenicia Judicial en España en el siglo XIX

Abstract

El presente trabajo aborda la evolución del poder judicial en distintos periodos de tiempo, desde un inicio en el que todo el poder se concentra en manos del rey, poder legislativo, ejecutivo y judicial, al punto de la separación de poderes que progresivamente se irá consiguiendo a lo largo de la historia. Podremos observar cómo van a ser los distintos tipos de pensamientos los que se van influir en los cambios de ver la política y la necesidad de tener un poder judicial al margen de los gobernantes. Será un proceso duro pero necesario. El auge de todo tiene lugar en la primera década del siglo XVIII donde España por los conflictos por la Francia napoleónica se verá con un vacío de poder donde serán creadas las Cortes de Cádiz y la Constitución de 1812, es el comienzo

This work approaches with the evolution of judicial power in different periods of time, from the beginning when all the power was concentrated in the hands of the king, legislative, executive and judicial power, to the point of the separation of powers that will progressively be achieved throughout history. We will be able to observe how the different types of thought will influence the changes in the way politics is seen and the need to have a judicial power outside of the rulers. It will be a hard but necessary process. The peak of all this took place in the first decade of the 18th century when Spain, due to the conflicts caused by Napoleonic France, found itself in a power vacuum where the Cortes of Cadiz and the Constitution of 1812 were created, the beginning of everything.
