EL DIVORCIO NOTARIAL: PROBLEMAS DE COMPETEN-CIA Y DE DERECHO APLICABLE

Abstract

El objeto del presente Trabajo Fin de Grado es analizar los problemas tanto de competencia internacional e interna como los de ley aplicable que presentan la disolución del matrimonio vía notarial en los supues-tos heterogéneos realizando previamente un análisis de Derecho com-parado. La importancia cuantitativa que está adquiriendo en los últimos tiempos la disolución del matrimonio vía notarial evidencia el interés del tema y la necesidad de su tratamiento desde la perspectiva del Derecho internacional privado al ser un ámbito en el que se aprecia, además, una creciente internacionalización y escasos estudios doctri-nales. The purpose of this Final Degree Project is to analyze the prob-lems of both international and internal competition as well as those of applicable law that present the dissolution of marriage by notarial means in heterogeneous cases previously carrying out a com-parative law analysis.. The quantitative importance that the disso-lution of marriage is acquiring in recent times through notarial evi-dence evidences the interest of the subject and the need for its treatment from the perspective of private international law as it is an area in which there is also a growing internationalization and scarce doctrinal studies.
