El ESTATUTO DE AUTONOMIA COMO FUENTE. ESPECIAL FIN DE GRADO REFERENCIA A LA STC 31/2010

Abstract

[ES] El Estatuto de Autonomía es una figura de la cual han surgido numerosas controversias en los últimos años. Las cuales son: su naturaleza jurídica, la posición que ocupa dentro del ordenamiento jurídico, el estatal así como el autonómico, el reparto competencial y la declaración de derechos estatutarios. Por otro lado, también la posibilidad de darle valor retroactivo a un Estatuto de Autonomía tras una Sentencia del Tribunal Constitucional y, por último, las reformas constitucionales y las consecuencias que derivan de las mismas, como por ejemplo, la STC 3112010, de 28 dejunio, parte fundamental de este trabajo, que analizaremos en profundidad.[EN] Resumen en inglés (máximo 15Opalabras) The Statute of Autonomy is a figure from which numerous controversies have arisen in recent years. Which are: its legal nature, the position it occupies within the legal system, the state as well as the autonomic, the division of powers and the declaration of statutory rights. On the other hand, also the possibility of giving retroactive value to a Statute of Autonomy after a Constitutional Court Judgment and, finally, the constitutional reforms and the consequences that derive from them, such as, for example, STC 31/2010, of June 28, a fundamental part of this work, which we will analyze in depth.
