EL CONTROL JUDICIAL DEL LAUDO ARBITRAL

Abstract

[ES] El presente trabajo de investigación se enmarca en el ámbito del Derecho Procesal Civil. Dentro del él partimos de la institución de arbitraje, como método heterocompositivo y extrajudicial de resolución de conflictos en aquellas materias en las que el principio de autonomía de la voluntad adquiere especial relevancia a la hora de configurar las relaciones jurídicas. Concretamente, este trabajo analiza el control judicial que se ejerce sobre los laudos arbitrales y sus límites, así como la alarma que los recientes fallos acerca de laudos sobre swaps del Tribunal Superior de Justicia de Madrid han despertado entre los miembros del colectivo arbitral. Asimismo, este trabajo compara la deficiente normativa española relativa a la protección de los consumidores y usuarios con la jurisprudencia proporcionada por el Tribunal de Justicia de la Unión Europea.

[EN] This research belongs to the field of Civil Procedural Law. We start from the arbitration institution, as heterocompositive and extrajudicial method of conflict resolution in those areas in which the principle of autonomy is particularly relevant when configuring legal relations. Specifically, this paper analyzes the judicial control exercised over arbitration awards and limits, as well as the alarm that the recent decisions on awards on swaps the High Court of Madrid has aroused among the members of the arbitration group. Also, this paper compares the deficient Spanish legislation on the protection of consumers and users with the case law provided by the Court of Justice of the European Union.
