TRANSFERENCIA INTERNACIONAL DE DATOS; RÉGIMEN JURÍDICO.

Abstract

El presente estudio nos muestra la vigente legislación en materia de protección de datos y su ineludible evolución donde las instituciones europeas han jugado un papel de vital importancia a la hora de subsanar las controversias surgidas. Se analizan sentencias clave que han desafiado la legislación europea que sirven de precedentes para la implantación de una unificada y proactiva legislación. El estudio de algunos preceptos del Reglamento General de Protección de Datos que atañe al Derecho internacional privado nos trasmite una elevada seguridad en esta materia, pero la vertiginosa evolución tecnológica y los defectos de contenido analizados por algunos expertos auguran una posible futura modificación en la legislación.

This study shows us the current legislation on data protection and its inescapable evolution where the European institutions have played a vital role in settling disputes that have arisen. Key judgments that have challenged European legislation that serve as precedents for the implementation of a unified and proactive legislation are analyzed. The study of some precepts of the General Data Protection Regulation that concerns private international law transmits a high degree of security in this matter, but the dizzying technological evolution and the content defects analyzed by some experts predict a possible future modification in the legislation.
