ESTUDIO DE LA RESPONSABILIDAD PENAL DE LAS PERSONAS JURÍDICAS Y “COMPLIANCE” EN UN CASO DE GESTIÓN Y ALMACENAMIENTO DE RESIDUOS PELIGROSOS

Abstract

[ES] Se analiza jurídicamente la situación de la responsabilidad de la persona jurídica tanto en el procedimiento sancionador administrativo como en el procedimiento penal, teniendo en cuenta la modificación realizada recientemente por la LO 1/2015 y 2/2015. Se estructura en tres apartados, siendo el primero el desarrollo del procedimiento sancionador en el supuesto, el segundo trata de la responsabilidad de la persona jurídica regulada en el art. 31 bis del Código Penal y, por último, se aporta Compliance Penal para demostrar la no responsabilidad o responsabilidad de la persona jurídica, y su admisión para tener efectos como atenuante o eximente de la responsabilidad penal de la persona jurídica.[EN] The situation regarding the liability of the legal entity is analyzed in both the administrative sanction procedure and the criminal procedure, taking into account the modification recently made by LO 1/2015 and 2/2015. It is structured in three sections, the first being the development of the sanctioning procedure in the case, the second deals with the liability of the legal entity regulated in art. 31 bis of the Criminal Code and, finally, criminal liability is provided to demonstrate the non-responsibility or liability of the legal entity, and its admission to have effects as mitigating or exonerating the criminal liability of the legal entity.
