[ES] En el presente trabajo se aborda la cuestión fundamental de si el hecho de declarar la guerra uno o varios Estados a otro, implica que a quien declaran la guerra es o no otro Estado, y por lo tanto, tratar de verificar si la declaración de guerra funciona como un mecanismo de reconocimiento, centrándome en el tema concreto del Estado Islámico. La definición morfológica de guerra alude a que es un conflicto armado entre dos o más Estados, pero el derecho internacional no reconoce que al declarar la guerra, se esté reconociendo como tal al otro contendiente. Por ello, la finalidad que persigue este trabajo de investigación es intentar contribuir a la aclaración relativa de si la guerra equivale, o no, al reconocimiento de Estados.
[EN] In this paper, the fundamental question as to whether declaring war on one or more states means that whoever declared the war is or not another state and therefore try to verify if the declaration of war functions as a mechanism of recognition. The specific issue of the Islamic State will be tackled in this paper. The morphological definition of war is an armed conflict between two or more States, however international law does not recognize that. By declaring war, it is being recognized as such to another contender. Therefore, the aim pursued this research is to try to contribute to the clarification on whether the war is equivalent or not the recognition of States.
