ELIMINACIÓN DEL REQUISITO DE REPRESENTACIÓN GRÁFICA EN LAS MARCAS DE LA UNIÓN EUROPEA

Resumen
[ES] Las nuevas tecnologías y la consolidación del marketing sensorial hacen que la realidad de la industria comercial cambie a cada momento, sobre todo en lo relativo a las marcas. El derecho es una ciencia que debe adaptarse de manera continua a la realidad social y es por eso que hacía falta una reforma en materia de derecho de marcas. Como resultado de estos cambios, el 23 de marzo de 2016, la Unión Europea de Comercio Reglamento (UE ) 2015/2424 Marcos entró en vigor . El nuevo Reglamento modifica el Reglamento sobre la marca comunitaria Comercio 207/2009 / CE , y hace una serie de cambios de procedimiento y de fondo a la ley de marcas de la UE . La mayor parte de las disposiciones de la nueva regulación son efectivas inmediatamente , mientras que el resto están programadas para entrar en vigor en octubre de 2017. Concretamente, uno de los mayores cambios es la eliminación del requisito de representación gráfica, lo que permitirá la entrada en el registro de signos no visuales de manera más fácil y sobre ello se centrará este trabajo.
[EN] The new technologies and the consolidation of the sensory marketing make that the reality of the commerce industry changes at every moment, especially in everything related to trademarks. It is known that law is a science which has to get used to the social reality constantly and that is the reason for the reforms in trademarks law. As a result of these changes, on 23 March 2016, European Union Trade Mark Regulation (EU) 2015/2424 came into force. The new Regulation amends Community Trade Mark Regulation 207/2009/EC, and makes a number of procedural and substantive changes to EU trade mark law. Most of the new Regulation’s provisions are effective immediately, with the remainder scheduled to come into force in October 2017. Specifically , one of the bigest exchange is abolishing the requirement of graphic representation, what will allow the registry of no visual signs in an easier way and about it I will focus this work.
