YIHADISMO TERRORISTA: HISTORIA, BASE DOCTRINAL Y JURISPRUDENCIA ESPAÑOLA

Abstract

En el presente trabajo se lleva a cabo un estudio sobre las partes más importantes y que conciernen al tema de la Yihad, su discurso de odio y la jurisprudencia que le atañe. De esta manera, podremos tener un conocimiento más claro sobre el significado de Yihad, cuándo se origina, qué opiniones fragmentan a la población musulmana, cómo ha evolucionado la Yihad y quiénes han sido sus dirigentes hasta nuestros días. Asimismo, se estudiará la jurisprudencia española, pues se intenta prevenir el terrorismo en la gran mayoría de sus ámbitos, desde respetar y no vulnerar derechos hasta controlar a quienes ejercitan su labor docente en las Escuelas Públicas, dado que estos asuntos deben estar muy supervisados para evitar la captación y propulsar el conocimiento de los jóvenes. Finalmente haremos referencia al TEDH, y veremos alguna sentencia sobre el terrorismo Yihadista en España. In the present work, we will carry out a study on the most important parts and those that concern the subject of the Jihad, its discourse of hate and the jurisprudence that concerns it. In this way, we will be able to have a clearer knowledge about the meaning of Jihad. In its history, we will see many of the motivations that continue to drive its supporters to carry out attacks nowadays. We will also study the Spanish jurisprudence, since, as explained throughout the work, we are trying to prevent terrorism in the vast majority of its domains, from respecting and not violating rights to controlling who teaches in public schools, since these matters must be highly supervised to prevent recruitment and to promote the knowledge of young people. Finally, we will refer to the ECHR, and we will see some specific rulings on Jihadist terrorism in Spain.
