LAS MEDIDAS CAUTELARES EN EL PROCESO CIVIL

Abstract

[ES] En el proceso civil, las medidas cautelares son el espejo del derecho a la tutela judicial efectiva, plasmado en el Artículo 24 de la Constitución Española de 1978, con el objeto de evitar que un eventual fallo favorable con respecto a la pretensión deducida quede privado de eficacia como resultado de la ejecución de conductas opuestas al derecho por la parte deudora. Por ello, el objeto de este trabajo es entender el régimen que la novedosa Ley de Enjuiciamiento Civil dispone en lo referente a las medidas cautelares.

[EN] In the civil process the precautionary measures are the mirror of the right to effective judicial protection embodied in article 24 of the Spanish Constitution of 1978, in order to prevent possible malfunction favorable with respect to the claim made is deprived of effectiveness as outturn of opposing the right by the debtor behavior. Therefore, the object of this work is to understand the regime that the new code of civil procedure has regarding precautionary measures.
