EL DESPERTAR DEL MIEDO INSUPERABLE: SUPUESTOS DE VIOLENCIA HABITUAL SOBRE LA MUJER

Abstract

[ES] Con este trabajo se pretende abordar el problemático tema sobre el valor que tiene o que se le da en la actualidad a la eximente de miedo insuperable, concretamente en supuestos de violencia habitual sobre la mujer. Partiremos desde sus orígenes y su controvertida naturaleza, hasta llegar a una conclusión sobre si realmente resulta necesaria esta eximente en el marco penal de la actualidad. No obstante, para ello no solo haremos referencia a sus requisitos, sino también a casos jurisprudenciales que proyectan diversas perspectivas tendentes a evaluar de una u otra manera la citada eximente.

[EN] The project´s intention is to approach the problematic topic about the value that has or that is given at present to the exculpatory of insurmountable fear, specifically in alleged cases of common violence of women. Starting in its origins and its disputed envioronment, until reaching a conclusion on wether this exemption is really necessary in today´s penal framework. However, we will not only refer to its requirements, but also to jurisprudential cases that project different perspectives tending to evaluate in one way or another the aforementioned defence.
