CLÁUSULAS SOCIALES EN LA CONTRATACIÓN PÚBLICA: NOVEDADES QUE INTRODUCE LA LEY 9/2017

Abstract

[ES] El actual trabajo trata de recabar las novedades que ha supuesto la entrada en vigor de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, en materia de cláusulas sociales y medioambientales, entre otras novedades.

Primeramente, se hace referencia a la finalidad de las cláusulas sociales, que tratan de hacer en materia de contratación pública y el marco normativo que las envuelven.

Seguidamente, se pueden ver las novedades más importantes que ha supuesto la entrada de esta ley, en relación a las cláusulas sociales y medioambientales y como ha afectado al sistema de contratación en general.

Más adelante, se señalan los criterios que se han de seguir para la implementación de estos aspectos sociales y se mencionan las diferentes ventajas que supone la introducción de las cláusulas sociales.

Por último, se dará paso a las conclusiones finales que se han sacado del análisis del presente documento.

[EN] The current assignment seeks to compile the news that have led to the entry into force of Act 9/2017, November 8th, Public Sector Contracts, in terms of social and environmental clauses, among other news.

First of all, reference is made to the purpose of the social clauses, what they are trying to achieve in terms of public contracting and the normative framework that involves them.

Then, you can see the most important news that have led to the entry of this law, in regard to the social and environmental clauses and how it has affected to the contracting system in general.

Later on, the criteria to be followed for the implementation of these social aspects and, moreover, the different advantages of introducing the social clauses.

Finally, the final conclusions that have been extracted from the analysis of this document will be presented.
