EL DEPÓSITO IRREGULAR EN EL DERECHO ROMANO Y SU PROYECCIÓN ACTUAL

Abstract

[ES] En este trabajo tratamos el depósito irregular en el Derecho Romano, realizando un análisis detallado del origen de esta institución, cuáles son sus características, su objeto, las teorías doctrinales que se han realizado y su evolución. Veremos reflejado el debate que se suscita en relación a qué categoría de contratos reales pertenece, si efectivamente se trata de un depósito irregular o de un mutuo, y, el estudio de las distintas opiniones que manifiestan los autores y juristas de cada época, analizando cada una de ellas para, finalmente realizar una proyección sobre esta figura en nuestros días y darnos cuenta de que tiene claros nexos con determinadas prácticas bancarias realizadas de forma habitual en la sociedad actual.

[EN] In this work we treat the irregular deposit in the Roman Law, making a detailed analysis of the origin of this institution, what are its characteristics, its object, the doctrinal theories that have been made and their evolution. We will see reflected the debate that arises in relation to what category of real contracts belongs, if indeed it is an irregular deposit or a mutual, and, the study of the different opinions expressed by the authors and jurists of each era, analyzing each one of them to finally make a projection on this figure in our days and realize that it has clear links with certain banking practices carried out regularly in today's society.
