Resumen
Desde sus orígenes, la combinación de pena y medida de seguridad se ha establecido de acuerdo al sistema legal del momento (monista, dualista o vicaria!). El dualista es el que finalmente ha imperado, con la aplicación de la condena y posterior medida de seguridad, siendo en este caso, la libertad vigilada. Dicha medida postpenitenciaria ha incrementado su protagonismo con la Ley Orgánica 5/201O. En esta Ley, se destaca la peligrosidad y posible reincidencia de dos tipos de delincuentes: terroristas y delincuentes sexuales. La Reforma de 2013, establece como novedad el aumento de los casos en los que aplicar la libertad vigilada al final de la condena. Sin embargo, dicha Reforma no se adoptó y se mantuvo lo dispuesto en la LO 5/2010 . Actualmente, con la última Reforma, LO 112015, se ha añadido la imposición de la libertad vigilada, a su vez, para los delitos contra la vida dentro de las circunstancias que ordena.
Since its beginnings, the combination between penalty and security measure has been established according to the legal system of every moment (monist, dualist or vicariate). The dualist legal system has been the one which has prevailed. It consists on the implementation of the punishment and a security measure afterwards, being the latter probation. This measure has become increasingly important due to "Organic Law 5/2010". It highlights the importance of level of danger and the risk of recidivism of two kinds of criminals: sex offenders and terrorists. 2013 Reform establishes as a new feature, the increase in cases where Probation is implemented at the end of the punishment. Nevertheless, no 2013 Reform was taken and the LO 5/2010 related to probation remained in force. Currently, the new Reform, LO 1/2015, adds the implementation of probation, not onlv for the criminal offences where was applied befare, but also for the crimes against life.
