Resumen
[ES] En este trabajo buscamos conocer si las garantías establecidas por
el ordenamiento jurídico español, como son la inmunidad y
aforamiento de los altos cargos públicos, pueden llegar a ser, hoy
día, denominados como contrarios o invasivos a los derechos
fundamentales a la igualdad y a la tutela judicial efectiva. A través
de la jurisprudencia de nuestro Tribunal Constitucional, veremos
cómo funcionan, y que fin persiguen para poder determinar si
realmente es necesaria su reforma, o al menos su limitación, y
encajar mejor su aceptación dentro de nuestra sociedad. Veremos
también como se regulan dichas prerrogativas en los países
vecinos, y abordaremos las conclusiones sacadas durante este
estudio.

We will also see how these prerogatives are regulated in neighboring countries, and we will address the conclusions drawn during this study.
