DIVERSOS ASPECTOS DE DERECHO DE FAMILIA

Abstract

[ES] El presente dictamen estudia la viabilidad de las pretensiones de un divorcio contencioso en el que se discuten algunos de los extremos más polémicos que encontramos en la práctica judicial. Así pues, se discute la posible viabilidad de ejercer la guarda y custodia de los menores separando a los hermanos, con un estudio del principio de no separación de hermanos. Por otro lado, se pretende la reducción de la pensión de alimentos alegando distintos motivos. Otra de las cuestiones a resolver es la posibilidad de solicitar la pensión compensatoria una vez que se ha renunciado a la misma en la separación previa. El regimen de visitas de la menor lactante también es objeto de dicho dictamen. Y por último la posibilidad de acumular la acción de división de la cosa común y el divorcio en un mismo proceso.

[EN] The present opinion studies the viability of the pretensions of a contentious divorce in which there are discussed some of the most polemic ends that we find in the judicial practice. This way so, the possible viability is discussed of exercising the guard and custody of the minors separating the brothers, with a special study of the beginning of not brothers' separation. On the other hand, the reduction of the alimony is claimed invoking different motives. Other one of the questions to resolving is the possibility of requesting the compensatory pension as soon as the same one has been resigned in the previous separation. The regime of visits of minor breast-fed baby also is an object of the above mentioned opinion. And finally the possibility of accumulating the action of division of the common thing and the divorce in the same process.
