Resumen
La maternidad subrogada es una técnica de reproducción asistida por la cual una mujer, madre gestante, asume el compromiso de gestar a un niño para que una o varias personas, comitentes, puedan establecer una filiación respecto del mismo. El propósito fundamental de este trabajo es realizar una revisión bibliográfica sobre el tema de la maternidad subrogada y las diferentes circunstancias que lo rodean en el contexto del estado español. Los aspectos teóricos fundamentales girarán en torno a dos objetivos. Por un lado, los derechos morales y legales tanto de la madre gestante como del niño. Por otro lado, nos centraremos en la dignidad humana; discutiremos si ésta se ve contradicha en la maternidad subrogada, si se mercantiliza, instrumentaliza, cosifica, discrimina y disgrega la unicidad personal de la mujer gestante. En resumen, se analizará la autonomía de la cual goza la mujer y la utilización de ésta como medio para un fin y no como un fin en sí misma.
Surrogate motherhood is an assisted reproductive technique in wich a woman, a pregnant mother, take on the engagement of giving birth to a child so that one or more persons, constituents, can establish a relationship with the child. The main purpose of this work is to conduct a literatura review on the subject of surrogate motherhood and the different circumstances taht surround it in the context of the Spanish State. The fundamental theoretical aspects will revolve around two objectives. On the one hand, the moral and legal rights of both the pregnant mother and the child. On the other hand, we will focus on human dignity; We will discuss if this is contradicted in surrogate motherhood, if the personal uniqueness or the pregnant woman is commodified, instrumentalized, reified, discriminated and disaggregated. In summary, the autonomy enjoyed by women and the use of women as means for an end and not as an en in itself, will be analyzed.
