Resumen
[ES] El estudio del delito de denuncia falsas, es una materia compleja y particular que el vigente Código
Penal regula en el artículo 456. Los motivos del estudio de este tipo delictivo son de diverso índole
unido a un contexto procesal que tiene una gran tradición y evolución histórica en la codificación y
sistema punitivo español, lo que ocasiona en ocasiones dificultades jurídicas y prácticas. Se trata de
un tipo penal con una importante evolución histórica que ha llegado a generar cuestiones complejas
en diversos aspectos de carácter penal, las cuales, tratan de ser resueltas por nuestra doctrina y
jurisprudencia. De esta forma, por medio del presente trabajo, se abordará de forma general este
tipo penal, abordando las cuestiones y debates principales que genera, haciendo especial hincapié en
el bien jurídico protegido, en el tipo de injusto del delito, en la justificación y exculpación, autoría y
participación, iter criminis y punibilidad del delito así como en los concursos de delitos a los que se
enfrenta y la diferenciación que posee frente a estos.
[EN] The study of the crime of accusation and false enunciation, is a complex and particular subject that the current Penal Code regulates in its articles 456 and 457. The reasons for the study of this type of crime are of various kinds linked to a procedural context that has a great tradition and historical evolution in Spanish codification and punitive system, which sometimes causes legal and practical difficulties. It is a criminal offense with an important historical evolution that has come to generate complex issues in various aspects of criminal law, which, try to be resolved by our doctrine and jurisprudence. In this way, through this work, this criminal type will be addressed in a general way, addressing the main issues and debates that it generates, with special emphasis on the protected legal right, the type of unjust crime, the justification and exculpation , authorship and participation, iter criminis and punishability of the crime as well as in the contests of crimes that it faces and the differentiation it has against them.
