EL PERFIL DEL/DE LA TRABAJADOR/A SOCIAL EN LOS JUZGADOS DE FAMILIA: ESPECIAL CONSIDERACIÓN A LA CUSTODIA COMPARTIDA

Abstract

Este Trabajo Fin de Grado pretende mediante una revisión bibliográfica, legislativa y jurisprudencial acercar el papel del trabajador/a social al ámbito del Derecho de Familia, especialmente dedica parte del mismo a analizar conceptos relacionados con las crisis matrimoniales en aquellos supuestos en los que hay menores y/o hijos/as con la capacidad modificada, de manera que se debe fijar el régimen de guarda y custodia y es aquí donde se analiza el papel del trabajador/a social como profesional auxiliar al servicio del órgano judicial, que valorará de manera objetiva, a petición del Juez o Magistrado o de las partes, los condicionantes sociales que rodean el caso concreto para realizar un informe no vinculante que permita al órgano judicial determinar la medida más adecuada teniendo en cuenta el principio fundamental dei interés superior del menorThis Final Degree Paper aims to bring the role of the worker/social to the field of Family Law through a bibliographic, legislative and jurisprudential review, especially devotes part of it to analyzing concepts related to marital crises in those cases in which there are minors and/or children/s with the modified capacity, in such a way that the system of care and custody must be established and it is here that the role of the social worker as a professional auxiliary to the service of the judicial body is analysed, which will evaluate objectively, at the request of the Judge or Magistrate or the parties, the social constraints surrounding the specific case in order to produce a non-binding report enabling the judicial body to determine the most appropriate measure taking into account
