RÉGIMEN JURÍDICO DE LA GUARDA Y CUSTODIA COMPARTIDA

Abstract

[ES] La ley 15/2005 de 8 de julio, que modificaba el Código Civil y la Ley de Enjuiciamiento Civil, en materia de separación y divorcio, introduce el nuevo modelo de guarda y custodia compartida frente a la exclusiva, que otorga la oportunidad a los progenitores de cumplir con sus obligaciones materno y paterno filiales. La autoridad judicial valorará los criterios de atribución de la guarda y custodia compartida, así como aspectos como la atribución de la vivienda familiar, todo ello en base al interés superior del menor, que será tratado en el trabajo. Al igual, se hará referencia a cuestiones relevantes sobre la custodia compartida, como puede ser el caso de un preso y la pensión alimenticia a sus hijos, el régimen de visitas o la custodia compartida.

[EN] The Law 15/2005, July8𝑡ℎ, by which the Civil Code and the Civil Prosecution Law are modified in terms of separation and divorce, introduces the new model of shared custody versus the exclusive, which gives the opportunity for parents to fulfill their maternal and paternal filial obligations. The judicial authority will assess the criteria for allocation of shared custody, as well as aspects such as the attribution of the family home, all based on the interests of the child, which will be treated in the project. Like, referring to relevant issues on shared custody, as can be the case of a prisoner and alimony to their children, visiting arrangements or shared custody.
