Resumen
[ES] El empresario en materia de prevención de riesgos laborales tiene como objetivo
principal la protección integra de los trabajadores en la empresa, cuyo incumplimiento
dará lugar, entre otras, a la responsabilidad por daños y perjuicios.
En nuestro ordenamiento jurídico, la objetivación de la responsabilidad empresarial y su
aseguramiento, se constituyen en términos compatibles con la eventual concurrencia de
la responsabilidad civil. No es necesario que se produzca infracción de la norma,
aunque sí se requiere un acto ilícito o indebido, por parte del empresario. No obstante, la
mera existencia de un accidente en el lugar de trabajo no supone el surgimiento
automático de responsabilidad empresarial ya que se debe demostrar una efectiva
conducta empresarial motivadora directa del daño o que haya permitido incrementar el
riesgo propio de la labor. Para el cómputo del daño originado, aunque no existan
criterios legales, se acepta el Baremo de la LRCSCVM (actualizado por la Ley
35/2015).
[EN] The employer in the field of occupational risk prevention has as main objective the full protection of workers in the company, whose failure will result, among others, to liability for damages. In our legal system, the objectification of corporate responsibility and its assurance are constituted in terms compatible with the possible concurrence of civil liability. It is not necessary that the rule be violated, although an illegal or improper act by the employer is required. However, the mere existence of an accident in the workplace does not imply the automatic emergence of corporate responsibility since it must demonstrate an effective business conduct that directly motivates the damage or that has increased the risk inherent in the work. For the calculation of the damage originated, although there are no legal criteria, the Scale of the LRCSCVM is accepted (updated by Law 352015).
