EL CONVENIO REGULADOR: UNA SOLUCIÓN A LAS CONTROVERSIAS DE LA CRISIS MATRIMONIAL

Abstract

[ES] El objeto del presente trabajo es analizar los conceptos básicos de una de las figuras más relevantes que tiene lugar cuando surge una crisis matrimonial: el Convenio Regulador. Éste se presenta como un negocio jurídico de carácter contractual, documento en el que los cónyuges pactan de mutuo acuerdo las relaciones económicas y personales, y donde se regularán las consecuencias que provocarán la situación de separación y divorcio. El estudio del convenio regulador nos permite distinguir elementos subjetivos participantes en el mismo, como son los cónyuges, hijos mayores y menores de edad, abuelos, el órgano judicial y el Ministerio Fiscal; y por otra parte se debe hacer referencia a los contenidos mínimos que vienen establecidos en el artículo 90 del Código Civil unos referidos a materias atinentes a los hijos y otros a los aspectos económicos entre los cónyuges. Por último, veremos también la importancia de la homologación y/ aprobación judicial del mismo.

[EN] The subject of the present work is to analyse the basics of one of the most outstanding issues that arises whenever a rough patch comes up: the Regulatory Agreement. Such comes over as a contractual-natured legal bussines. It is a document through which spouses by mutual agreement settle up their personal and financial relations. The document also establishes the consequences proper to legal separation and divorce. All through the presentation of the Regulatory Agremeent a number of subjective elements come up, namely: the spouses, the cohabitants, minor children and those of legal age, the grandparents, the judiciary and the public prosecution, as well as the minimum contents provided for in Article 90 of the Civil Code. A number of these refer to children welfare and some others to spouses. We will also deal with the relevance of homologation and legal approval of this subject.
