EL PROCESO MONITORIO: ANALISIS COMPARATIVO ENTRE EL SISTEMA ESPAÑOL Y EL ITALIANO

Abstract

En el presente Trabajo se estudiará un análisis entre el proceso monitorio español y su figura italiana. Se partirá de un estudio de los antecedentes históricos y su origen en Ja alta edad media italiana, así como su inserción en el Ordenamiento Español. En el siguiente bloque se estudiará el proceso monitorio en España. lo que incluye los principios que lo regulan, jurisdicción . competencia. partes y procedimiento. así como su naturaleza . Iguales previsiones se analizarán de cara al proceso de requeri miento o monitorio italiano, destacando como idea principal que tanto su carácter documental como la estructura de su procedimiento se asemejan a las del proceso monitorio español. Los procesos monitorios de uno y otros sistemas difieren sobre todo en la naturaleza del título y en pocas peculiaridades que se exponen en las conclusiones de este Trabajo.

In this research project we will study an analysis the Spanish small claim procedure in front of the Italian procedure. We will start of previous history studio and his origins in the Italian middle ages, as his insertion on the Spanish system. In the following topic we will study the Spanish small claim procedure, including the beginning that regulate, jurisdiction. competence, parts and the procedure of Italian requirement and his nature. The same aspects we will study in the ltalian small claim procedure. focussing as main idea, which his documental character as his structure of the process, are similar to the Spanish small claim procedure. The small claim procedure of both do not have a really big difference in their nature, only have a few points of divergence which are showed an analysis in the conclusion of this research project.
