Aforamiento y inmunidad de los cargos públicos

Resumen
La inviolabilidad, la inmunidad y el aforamiento son garantías procesales que otorgan a sus titulares una ventaja respecto al resto de ciudadanos, por el cargo que tienen o la función que desempeñan.
Concretamente, el aforamiento supone ser juzgado por tribunales superiores, en lugar de por los ordinarios que corresponderían. Hoy en día, es un tema muy debatido por varios motivos, entre ellos, podemos destacar que, en España, existe un excesivo número de personas que ostenta esta condición y que la práctica parece estar desvirtuando el objetivo principal de esta prerrogativa parlamentaria, haciendo de ella un privilegio personal.
Mención aparte merece la Ley reguladora del Alto Cargo de la Administración General del Estado publicada el día 31 de Marzo
• de 2015, la cual tiene como finalidad que el alto cargo público se
desempeñe con la máxima transparencia y legalidad posible.

Specifically, nowadays, "aforamiento" means to be judge by higher court than ordinary related. This is a topic very debated for many reasons, among which, we can say that, in Spain exist a high number of people that hold this conditíon and the practice can be distorting the main objective of this parliamentary privilege, changing this in a personal privilege. Special rnention deserves the new law, "Leyreguladora del Alto Cargo de la Administración General del Estado", published in March 31st, 2015, which has as objective that the high public position carry out this job with transparency and legality
