La tutela automática y el acogimiento como mecanismo de protección de menores en desamparo. Evolución y marco conceptual

Abstract

[ES]La familia es el entorno natural socializador, educativo y de crianza para un menor. Pero a veces, el entorno que debiera ser el apropiado se vuelve perjudicial. Ante esta situación una de las respuestas legales es declarar la situación de desamparo del menor. Esta situación es el punto de partida que dará lugar al desarrollo de las medidas que en este trabajo se tratan. Partimos de este contexto de desprotección del menor y de la responsabilidad por parte de los padres o tutores para encaminarnos al estudio de dos de las medidas que se toman ante la situación de desprotección del menor, la tutela automática y el acogimiento.[EN]Family is the socializing, parenting education and natural environment for a child. But sometimes, the environment should be appropriate becomes harmful. In this situation one of the answers is to declare the legal situation of helplessness of the child. This situation is the starting point that will lead to the development of measures that are discussed in this paper. We start from this context of vulnerability of the child and responsibility on the part of parents or guardians to encaminarnos the study of two of the measures taken against the lack of protection of minors, automatic protection and care.
