La escuela correccionalista española

Abstract

La escuela correccionalista española es una de las corrientes más peculiares y modernas que se han desarrollado en nuestro territorio. Esta corriente de pensamiento está basada en las ideas humanitarias impera11tes del momento y su esencia no es otra que corregir las voluntades pervertidas de los delincuentes, siempre con el uso de tratamientos o medidas benévolas y correctas, con el objetivo de conseguir el restablecimiento del orden jurídico en beneficio de la sociedad y sus integrantes. Entre sus miembros, podemos encontrar juristas de la talla de Concepción Arenal, Dorado Montero y Luis Silvela, quienes consiguieron un gran éxito debido a sus innovadores planteamientos relacionados con el Derecho Penal. Sin embargo, a pesar de estas características, ha sido infravalorada y criticada desde su nacimiento, por lo que su estudio ha sido evitado en una gran cantidad de obras. Por ello, el propósito de este trabajo es darle el estudio merecido.

The Spannish correctionalist school is one of the most interesting and modern movements that have been developed in our territory. This current of thought is based in prevailing humanitarian ideologies of the moment and his essence was no other than to correct the perverted wills of delinquents, always with the use of benevolent and correct measures or treatments, in order to achieve the restoration of the legal system for benefit of society and its members. Among its members, we can find authors of statt1re such as Concepción Arenal, Dorado Montero or Luis Silvela, who achieved a great success due to their innovative proposals related to criminal law. However, despite of these statements, it has been underestimated and criticized since it was born, so this study has been avoided in a huge amount of works. For that, the purpose of this work is to give it the study that it deserves.
