Resumen
[ES] Dentro de los derechos fundamentales reconocidos en la Constitución Española, el derecho a la educación es uno de los más importantes ya que está considerado como un derecho inherente para todas las personas. Desde la entrada en vigor de la Constitución, este derecho ha sido desarrollado por más de siete Leyes Orgánicas que se han encargado de concretar las materias de reparto conforme a la Constitución, en materia educativa. Esta multitud de Leyes Orgánicas han tenido una vinculación directa con los partidos políticos ya que dependido del partido que gobernara en ese momento, se modificaba o derogaba la anterior, adaptando la ley a su ideología política.
A través de este trabajo de investigación pretendo aclarar que competencias son del Estado y cuáles de las comunidades autónomas, en concreto Andalucía, Cataluña y País Vasco para desarrollar el pensamiento crítico del lector/a en materia educativa.
[EN] Within the fundamental rights recognized in the Spanish Constitution, The right to education is one of the most important because it is considered an inherent right for all people. Since the entry into force of the Constitution, this right has been developed by more than seven Organic Laws that have been in charge of specifying the distribution matters according to the Constitution, in educational matters. This multitude of Organic Laws have had a direct link with the political parties since it depended on the party that governed at that time, modified or repealed the previous one, adapting the law to its political ideology. Through this research I intend to clarify which competences are of the State and which of the autonomous communities, in particular Andalucia, Cataluña and Pais Vasco, to develop the critical thinking of the reader in educational matters.
