VENTA A PÉRDIDA COMO ACTO DE COMPETENCIA DESLEAL

Resumen
En el presente trabajo, analizaremos uno de los actos de
competencia desleal que crea cierta confusión entre los usuarios y
consumidores del mercado ya que esta práctica las cual es
considerada como desleal, conocida como la venta a pérdida, la
cual analizaremos a continuación, es en principio lícita en base al
principio de que la fijación de precios es libre como así lo
establece la Constitución Española.
A pesar de lo anterior, encontramos excepciones en las que la
venta a pérdida se considerará ilícita por no ajustarse a la buena fe
que se exige en el mercado. Alguna de estas excepciones las
encontramos recogidas en la Ley 29/2009, de 30 de diciembre de
Competencia Desleal así como en la Ley 7/1996, de 15 de enero,
de Ordenación del Comercio Minorista.
In this paper, we will analyze one of the acts of unfair competition that creates confusion among users and consumers of the market since this practice which is considered unfair, known as selling at a loss, which we will analyze below, is in principle legal based on the principle that pricing is free as established by the Spanish Constitution. Despite the foregoing, we find exceptions in which the sale at a loss will be considered illicit because it does not comply with the good faith that is required in the market. Some of these exceptions are those contained in Law 29/2009, of December 30, on Unfair Competition as well as in Law 7/1996, of January 15, on the Regulation of Retail Trade.
