Resumen
[ES] El presente trabajo tiene por objeto abordar el tema de la responsabilidad ante un daño medioambiental. El ordenamiento jurídico actúa imponiendo responsabilidades administrativas, penales y/o civiles. Los poderes públicos velarán por la protección del medioambiente regulando, por un lado, el “daño ecológico puro” por La Ley de Responsabilidad medioambiental 26/2007 y su responsabilidad objetiva en base a los principios de evitación y “quién contamina paga” y por otro lado, la jurisprudencia civil protegerá los derechos y bienes patrimoniales privados afectados ante un daño ambiental, denominado “daño tradicional”. Asimismo, este trabajo analiza el hecho de que mediante las la garantía financiera el sector privado empresarial se asegura las futuras responsabilidades ambientales en las que pudiese incurrir. En este sentido, el desastre ecológico del Prestige hace replantearnos si el derecho actúa eficazmente ante un daño ecológico a escala internacional.
[EN] The purpose of this work is to address the issue of responsibility for environmental damage. The legal system acts by imposing administrative, criminal and / or civil responsibilities. The public authorities shall ensure the protection of the environment by regulating, on the one hand, the “pure ecological damage” by the Environmental Responsibility Law 26/2007 and the strict liability based on the principles of avoidance and “who pollutes pays”, and on the other hand, civil jurisprudence will protect the private property rights and assets affected from environmental damage, called “traditional damage”. Likewise, this work analyzes the fact that through the financial guarantee the private business sector ensures the future environmental responsibilities in which it could incur. In this sense, the Prestige ecological disaster makes us rethink whether the law acts effectively in the face of ecological damage at international level.
