Resumen
El Título XX CP castiga los delitos contra la Administración de
Justicia y dentro de este, es el Capítulo V el que regula la
acusación y denuncia falsas. Aunque el delito queda integrado en
el Título referido, se debe tener en cuenta que no sólo atenta
contra el sistema de justicia, sino que también afecta al honor de
las personas acusadas y denunciadas falsamente.
En este contexto, se realiza un recorrido de la evolución del tipo
delictivo, desde sus orígenes hasta la actualidad, abordando
además cuestiones relevantes tales como el bien jurídico objeto de
protección, la tipicidad objetiva y subjetiva, el iter criminis y su
similitud con otros delitos, además de las posibles relaciones
concursales. Finalmente se hace un breve pero conciso estudio del
fraude a las compañías de seguros y de la existencia y proporción
de denuncias falsas existentes en materia de violencia de género.
Title XX of the Criminal Code punishes crimes against the Administration of Justice and within this, Chapter V regulates false accusation and denunciation. Although the crime is included in the aforementioned Title, it should be taken into account that it not only attacks the justice system, but also affects the honor of the persons falsely accused and denounced. Thus, a review is made of the evolution of the criminal type, from its origins to the present day, also addressing relevant issues such as the legal property object of protection, the objective and subjective typicity, the iter criminis and its similarity with other crimes, as well as the possible concursal relations. Finally, a brief but concise study is made of fraud against insurance companies and the existence and proportion of false reports in the area of gender violence.
