EL TRATAMIENTO PENAL DE LA VIOLENCIA MACHISTA. APLICACIÓN DE LA NORMA Y SESGOS DE GÉNERO: LA MUJER VÍCTIMA DE MALOS TRATOS

Resumen
[ES] En los últimos años y tras la entrada en vigor de la CE., se ha producido en España una serie de reformas
legales para dar respuesta, desde el Derecho Penal, al fenómeno de la violencia de género. Esto ha
producido una evolución de nuestro ordenamiento jurídico que, partiendo de un derecho sexista que
incluía figuras delictivas sexuadas, ha pasado a ser concebido como un Derecho formalmente neutro. La
persistencia de la discriminación de género en la sociedad ha producido un salto cualitativo, introducido a
través de la LOIVG que, asumiendo la perspectiva de género en su regulación, introduce delitos sexuados,
para hacer frente a dicha discriminación material. Pero todas las reformas y opciones de política criminal
se han encontrado con un freno fundamental: los sesgos de género que, en la aplicación de la norma,
impiden la cabal perseguibilidad penal de estos hechos.
[EN] In recent years and following the entry into force of the Spanish Constitution, there have been a series of reforms to respond from criminal law to the phenomenon of gender violence. This has produced an evolution of our legal system that included sexually delinquent figures, has come to be conceived as a formally neutral right. The persistence of gender discrimination in society has produced a qualitative leap introduced through the LOIVG with, assuming the gender perspective in its regulation introduces sexed crimes, to deal whit such material discrimination. But all de reforms and opinions of criminal policy have been found with a fundamental brake: the gender biases that, in the application of de norm, prevent the complete criminal prosecutions of these facts.
