APLICACIÓN Y ALCANCE DEL ARTÍCULO 155 DE LA CONSTITUCIÓN ESPAÑOLA

Abstract

[ES] A lo largo de la historia de la Constitución de 1978, la aplicación del artículo 155 solo se ha dado en una ocasión, en el año 2017 ante la desobediencia de la Constitución por parte de la Comunidad Autónoma de Cataluña. Por ello, el alcance de las medidas derivadas de la puesta en marcha de esta disposición es ambigua, así como el tiempo que éstas deberían establecerse. En este trabajo se pretenden esclarecer estas cuestiones, así como comprobar si sería posible la aplicación del estado de excepción en lugar del art. 155 CE.

[EN] Throughout the history of the Constitution of 1978, the application of Article 155 has only occurred on one occasion, in the year 2017 as a consequence of the disobedience of the Constitution by the Autonomous Community of Catalonia. Therefore, the scope of the measures derived from the implementation of this provision is ambiguous, as well as the time there is. In this paper we try to clarify these questions, just as we can verify the application of the state in exception instead of art. 155 CE.
