Protección jurídica del pasajero en el transporte aéreo.

Abstract

El objeto de este trabajo fin de grado ha sido, primeramente, analizar el contrato de transporte aéreo de una persona que viaja, y, por consiguiente, los problemas a los que puede enfrentarse el pasajero o pasajera cuando realiza un viaje en aeronave. Los problemas que se han tratado a lo largo de este trabajo fin de grado son de gran relevancia por su frecuencia de ocurrencia y el malestar que ocasiona a las personas que viajan por medio aéreo. Así, este malestar se origina por diversas situaciones como cuando el equipaje sufre algún tipo de daño, cuando un vuelo se retrasa o se cancela, o como el tan popular problema de overbooking, entre otras situaciones. Además, en este trabajo, se ha planteado la cuestión de sí los daños morales por estas situaciones indeseables son indemnizables o no, sus respectivas resoluciones y, finalmente, se hace referencia al seguro del pasajero por medio aéreo. The purpose of this final degree thesis has been, firstly, to analyze the air transport contract of a person who travels, and, consequently, the problems that the passenger may face when traveling by aircraft. The problems that have been dealt with throughout this final degree project are of great relevance due to their frequency of occurrence and the discomfort they cause to people who travel by air. Thus, this discomfort is caused by various situations such as when luggage suffers some type of damage, when a flight is delayed or canceled, or as the popular problem of overbooking, among other situations. In addition, in this final degree project, the question has been raised as to whether the moral damages for these undesirable situations are compensable or not, their respective resolutions and, finally, reference is made to the insurance of the person who travels by air.
