Resumen
Uno de los problemas más relevantes que enfrenta actualmente el sistema penitenciario, es el número
de personas con trastornos mentales graves que cumplen medidas de seguridad privativas de libertad
en Hospitales Psiquiátricos Penitenciarios. El Real Decreto 190/1996, de 9 de febrero, por el que se
aprueba el Reglamento Penitenciario, artículo 209.2.1 establece que:
“La asistencia especializada a personas con enfermedad mental se asegurará, preferentemente, a
través del Sistema Nacional de Salud.”
Sin embargo, a pesar de que la ley establece que estas personas pueden ser atendidas en recursos
sanitarios comunitarios, lo más común es que terminen cumpliendo las medidas de seguridad que le
sean impuestas en los Hospitales Psiquiátricos Penitenciarios.
Es por este motivo, por el que buscaremos soluciones alternativas para estas personas. Enfocándonos
en modelos penitenciarios que permitan a la persona con trastorno mental grave una rehabilitación lo
más cercana posible a su entorno

Royal Decree 190/1996, of February 9, which approves the Penitentiary Regulations, article 209.2.1 establishes that: “Specialized assistance for people with mental illness will be ensured, preferably, through the National Health System.” However, although the law establishes that these people can be treated in community health resources, the most common thing is that they end up complying with the security measures imposed on them in Penitentiary Psychiatric Hospitals. It is for this reason that we will look for alternative solutions for these people. Focusing on penitentiary models that allow people with serious mental disorders rehabilitation as close as possible to their environment
