Resumen
El aumento del volumen del tráfico de órganos humanos ha hecho
posible la inclusión a través de la Ley Orgánica 5/2010 de un
nuevo precepto penal independiente tipificado en el artículo 156
bis del Código Penal, posteriormente reformado por la Ley
Orgánica 1/2019. Al margen de la escasa jurisprudencia dictada en
nuestra legislación española, se pretende analizar la legitimación
del Derecho Penal para tutelar y poner fin a estas situaciones. Del
mismo modo, ofrecer un estudio de los mayores problemas
suscitados en relación al bien jurídico protegido, objeto material,
interpretación de las conductas típicas, la diferencia entre el tipo
que se analiza, con la trata de personas con fines de extracción de
órganos y las nuevas modificaciones tras la entrada en vigor de la
última reforma en cuanto a los problemas concursales,
modalidades agravadas y consumación del delito.
The increase in the volume of human organ trafficking has made possible the inclusion through Organic Law 5/2010 of a new independent criminal precept typified in article 156 bis of the Penal Code, subsequently reformed by Organic Law 1/2019. Apart from the scarce jurisprudence in our Spanish legislation, the aim of this paper is to analyze the legitimacy of the Criminal Law to protect and put an end to these situations. Furthermore, it would be researched the major problems raised in relation to the protected legal right, material object, interpretation of the typical behaviors, the difference between the type that is analyzed with the trafficking of persons for the purpose of organ extraction and the new modifications after the entry into force of the last reform in terms of the problems concursale, aggravated modalities and consummation of the crime.
