LA ORDEN EUROPEA DE DETENCIÓN Y ENTREGA

Abstract

[ES] La orden europea de detención y entrega constituye un importante instrumento en el ámbito de la cooperación penal internacional que viene a sustituir, en los Estado miembros de la Unión Europea, la hasta ahora aplicable, orden de extradición cuando se trate de delitos en los que intervengan más de un Estado. La novedad que versa en esta orden de detención y entrega europea es el principio de reconocimiento mutuo entre los Estados miembros al constituir un espacio de libre circulación de persona en el que se busca garantizar la justicia y seguridad de sus ciudadanos. Se encuentra regulada por la Decisión Marco 2002/584/JAI, del Consejo, de 13 de junio de 2002 a nivel europeo y más concretamente en España por la Ley 23/2014, de 20 de noviembre, modificando a la anterior Ley 3/2003, de 14 de marzo. [EN] The European arrest warrant and surrender is an important instrument in the field of international criminal cooperation that replaces, in the Member States of the European Union, the so far applicable, extradition order in the case of crimes involving more than one State. The novelty of this European arrest and surrender order is the principle of mutual recognition between the Member States, as it constitutes a space for the free movement of persons in which it seeks to guarantee the justice and security of its citizens. It is regulated by Framework Decision 2002/584 / JAI, of the Council, of June 13, 2002 at European level and more specifically in Spain by Law 23/2014, of November 20, modifying the previous Law 3/2003, of March 14.
