Derechos y deberes del trabajador/a y poderes del empresario

Abstract

[ES] El presente trabajo de investigación versa sobre el estudio de los derechos y deberes del trabajador/a y de los poderes del empresario/a en el ámbito de las relaciones laborales. En primer lugar, partiendo de los derechos que protegen a todo trabajador/a, se analizan los derechos específicos e inespecíficos de los trabajadores/as y su correspondencia con los deberes que le son exigidos. En segundo lugar, se presenta el concepto de sistema de clasificación profesional para poder entender el modus operandi del empresario/a y su potestad para exigir determinadas obligaciones a los trabajadores/as y garantizar determinados derechos. En tercer lugar, se examinan las potestades del empresario/a enmarcadas en el poder de dirección y el poder disciplinario, que encuentran su fundamento en el derecho a la libertad de empresa. Por último, y en relación con la temática de este trabajo, se presenta la programación didáctica del módulo de Formación y Orientación Laboral en el Ciclo Formativo de Grado Superior de Patronaje y Moda que se imparte en el I.E.S. Pablo Picasso de Sevilla.

[EN] This research deals with the study of the rights and duties of the worker, as well as the powers of the employer in the scope of the industrial relations legislation. Firstly, and taking as a basis the rights aimed at protecting every worker, it is our main aim to analyse the specific and non-specific rights of workers in accordance with the rights which are required of them. Secondly, the concept of planning and development system is introduced in order to appreciate the entrepreneur’s modus operandi, as well as his/ her power to require for specific duties to workers and ensuring particular rights. Thirdly, the entrepreneur’s powers, framed within the decision-making power and disciplinary power, are examined. These above-mentioned are based on the right to the company law. Last but not least, and in connection with the main subject of this research work, it is introduced the syllabus of the Training and Labour Orientation Module in the Higher Grade Pattern and Fashion Training Cycle taught at the I.E.S. Pablo Picasso in Seville.
