SIMULACIÓN EN EL MATRIMONIO CANÓNICO

Abstract

El propósito de este Trabajo Fin de Grado es analizar la simulación como causa de nulidad del matrimonio canónico. Al igual que justificar por qué se utiliza cada día más para eludir el control previo al matrimonio y obtener otros fines ajenos a este. Ejemplo de ello sería la celebración del matrimonio para obtener la nacionalidad. En estos casos, se recurre a la vía canónica por tener un control posterior a la celebración y no anterior. Para todo ello, comenzaremos analizando el matrimonio, términos relevantes, cada tipo de simulación y finalizaremos con algunas sentencias sobre el tema. Este análisis partirá de aportaciones doctrinales y jurisprudenciales. Por supuesto, incluyendo fuentes legales y códigos correspondientes.

The purpose of this End-of-Degree Paper is to analyze simulation as a cause of nullity of canonical marriage. As well as justifying why it is increasingly being used to circumvent pre-marriage control and obtain other ends unrelated to marriage. An example of this would be the celebration of marriage to obtain nationality. In these cases, the canonical way is used because it has a control after the celebration and not before. For all this, we will begin by analysing the marriage, relevant terms, each type of simulation and we will end with some sentences on the subject.
