Abstract

Para poder tener un mayor conocimiento sobre el tema de estudio, se desarrollará en primer lugar tanto la definición de procesos especiales, como los caracteres que lo diferencian del procedimiento ordinario. Posteriormente se tratará, sobre la partición de la herencia. Definición, regulación legal, legitimación para pedir la partición de la herencia, trámites procesales de la división, así como la formación de inventario y los efectos que produce la rescisión. Se incluirán sentencias sobre la materia para tener una visión de la jurisprudencia sobre dicho tema. Tras todo esto, se procederá a ver un estudio detallado sobre la división del régimen económico matrimonial. Centrándonos en aspectos tales como que tipos de regímenes económicos existen en el matrimonio, así como la solicitud y formación de inventario y para finalizar la liquidación del régimen económico matrimonial. Dentro de los diferentes apartados se establecerá lo que recogen los diferentes tribunales sobre dicha materia. In order to have a better knowledge of the subject of study, the definition of specials trials will first be developed, as well as the characteristicts that differenciate it from the ordinary procedure. Afterwards, allocation of inheritance will be discussed. Definition, legal regulation, legitimation to request the partition of inheritance, procedural procedures of allocation, as well as the formation of inventory and the effects that the recission produces. Judgments on the matter will be included to have a view of the jurisprudence on this subject.

After this, a detailed study will be made on the división of the matrimonial property regime. Focusing on aspects such as the type of economic regimes which exist in marriage, as well as the request and formation of inventory and in order to finalize the liquidation of matrimonial economic regime. Within the different sections will be stablished what the different courts collect on this matter.
