Maternidad y paternidad. protección en situación de despido. Comparativa con la normativa italiana

Abstract

[ES]El trabajo presenta un análisis detallado de las prestaciones de maternidad y paternidad, profundizando en las situaciones protegidas, requisitos para el acceso a estas, su contenido, y otros aspectos como la duración y la extinción. Hasta llegar a la situación actual se hace además un recorrido histórico desde el s. XIX en el caso de la maternidad y desde el s. XX en el caso de la paternidad a través de la normas jurídicas que las han ido regulando. Además, se profundiza en la repercusión que puede conllevar la realización de despidos a trabajadoras que se encuentren en estado de gestación, disfrutando de la prestación, o que se hayan reincorporado al trabajo tras dicho periodo, para lo que se analiza la jurisprudencia existente. Finalmente, se incluye una comparativa entre la normativa española y la italiana en la materia con el objetivo de contemplar las diferencias entre ambos países.

[EN]This essay presents a detailed analysis of the maternity and paternity benefits, by highlighting the protected situations, the requirements to access them, their content, and other aspects like their duration and extinction. Before reaching the current situation, a historical overview is included, from the XIX c. in the case of maternity and from the XX c. in the case of paternity, through the legal standards that have regulated them. Additionally, it delves into the repercussion that firing gestating workers can carry, the ones who benefit from their maternity rights or those who have returned to work after that period; and for this, the legal precedents are examined. Finally, a comparative between the Spanish and Italian laws on the matter is included, with the aim of evaluating the differences between both countries.
