LA RESPONSABILIDAD PATRIMONIAL DE LA ADMINISTRACIÓN PÚBLICA Y EXPROPIACIÓN FORZOSA: LAS EXPROPIACIONES ILEGALES

Abstract

[ES] A lo largo del siguiente trabajo se aborda en base a la legislación actual la expropiación forzosa. Desarrollándose los aspectos más importantes de aquella tales como, el justiprecio o la causa expropiandi. Además se detalla las cinco fases del procedimiento ordinario expropiatorio, el cual es de vital relevancia para no concurrir en una actuación ilegitima por parte de la Administración. Centrándonos por tanto, en los diversos supuestos de expropiación ilegal dando lugar a una vía de hecho, basándonos en la jurisprudencia del Tribunal Supremo. Implicando la expropiación ilegitima en el perjudicado una serie de lesiones que deberán ser indemnizadas.

[EN] In the following work, forced expropriation is addressed based on current legislation. Developing the most important aspects of that such as, the justification or the expropriation cause. In addition, the five phases of the expropriatory ordinary procedure are detailed, which is of vital relevance in order not to participate in an illegitimate action by the Administration. Focusing therefore, in the various cases of illegal expropriation giving rise to a de facto way, based on the jurisprudence of the Supreme Court. Involving the illegitimate expropriation in the injured party a series of injuries that must be compensated.
