Modelos de responsabilidad de las personas jurídicas

Abstract

[ES]El siguiente trabajo desarrolla una visión de la evolución que han tenido las diferentes teorías de la responsabilidad de las personas jurídicas; desde la irresponsabilidad de la persona jurídica, hasta la actual imputación de su responsabilidad directa, pasando por un sistema de responsabilidad derivada. Me he centrado sobre todo en un estudio de los fundamentos y de la teoría de la pena de cada una de las teorías, poniendo de manifiesto al m ismo tiempo las insuficiencias de cada una de ellas.

[EN]This work develops a vision of the evolution that the different responsibility theories for legal entity have had; from the legal entity's irresponsibility to the actual system of responsibility imputation : the direct responsibility of the legal entity, passing by a system of responsibility derived. I focused mainly in study the basis and the punishment theory of each of the theories, demonstrating at the same time the shortcomings of each one of them.
