Discrecionalidad Judicial.

Abstract

El trabajo en general trata de la discrecionalidad judicial. Se indica cuales son las causas, los límites y los elementos que dan lugar a ella. También se puede observar las diferencias existentes entre los dos tipos de discrecionalidad que son: la judicial y la administrativa, además, de las diferencias que hay entre la discrecionalidad (es necesaria en la actividad que realiza el juez) y la arbitrariedad (no es lícita ya que afecta al derecho a la tutela judicial que tiene cualquier interesado). Otro punto del trabajo se refiere a las diferentes opiniones que existen en cuanto a la discrecionalidad. Introduzco reflexiones que van desde el problema de la discrecionalidad hasta las doctrinas que niegan su existencia. Por último, pongo de ejemplo dos casos reales en los que se pueden observar cierta discrecionalidad, además, de incluir una sentencia arbitraria con la respectiva explicación de lo que consiste por el Tribunal Constitucional.
