ANALÍSIS DEL ASESINATO HIPERAGRAVADO. ARTÍCULO 140 C.P.

Abstract

El fin de este trabajo es una profundización en el análisis del delito de asesinato hiperagavado introducido por la Ley Orgánica 1/2015, de 23 de noviembre. Para lograr un cumplimiento efectivo del este fin estudiaremos el delito de asesinato en la historia de los Códigos Penales de España, con una enseñanza teórica del marco penal del delito tipo básico y sus puntos en común con la hiperagravación. Analizaré en profundidad la hiperagravación con casos prácticos para su mejor entendimiento y finalmente comentaré la pena impuesta para este delito que viene a ser la llamada Pena de Prisión Permanente Revisable. The purpose of this work is a deepening in the analysis of the crime of hyper aggravation murder introduced by Organic Law 1/2015, of November 23. To achieve an effective fulfillment of this end, we will study the crime of murder in the history of the Spanish Penal Codes, with a theoretical teaching of the criminal framework of basic type crime and its points in common with hyper -aggravation. I will analyze in depth the hyper- aggravation with practical cases for your better understanding and finally I will comment on the penalty imposed for this crime that is known as the Reviewable Permanent Prison Penalty.
