LA ADMINISTRACIÓN DE JUSTICIA EN TIEMPOS DE PANDEMIA: ANÁLISIS SOCIOLÓGICO Y ORGANIZACIONAL EN TORNO A LA TUTELA JUDICIAL EFECTIVA EN BRASIL Y ESPAÑA

Abstract

Ese trabajo tiene como objetivo analizar el impacto de la pandemia de la COVID-19 sobre la tutela judicial efectiva ofrecida por el Estado, y dispensada por jueces y tribunales. Se analizan aspectos organizacionales y sociológicos para los casos de Brasil y España. Para ello se utiliza una metodología mixta, cuantitativa y cualitativa, apoyadas respectivamente en las siguientes fuentes: las estadísticas judiciales de 2020 y la perspectiva aportada por jueces brasileños y españoles. Los resultados permiten concluir que el modelo cooperativo entre Poder Judicial y Ejecutivo, aplicado en España, resulta en mayores índices de ingresos de procesos judiciales, productividad de los jueces y atención a la demanda. Fue posible verificar también que la reducción en la tutela judicial tiene implicaciones en la violencia sobre la mujer y menores delincuentes. Además, puede afectar la fuente de legitimidad del Estado, que en Brasil y España se basa en el derecho.

This study aims to analyze the impact of the COVID-19 pandemic on the effective judicial protection offered by the State, and dispensed by judges and courts. Organizational and sociological aspects have been interpreted through the cases from Brazil and Spain. For this, a mixed, quantitative, and qualitative methodology is used, supported respectively by the following sources: the 2020 judicial statistics and the perspective provided by Brazilian and Spanish judges. The results allow us to conclude that the cooperative model between the Judiciary and the Executive Branch, applied in Spain, results in higher rates of income from judicial processes, the productivity of judges, and attention to demand. It was also possible to verify that the reduction in judicial protection has implications for violence against women and juvenile offenders. In addition, it can affect the source of legitimacy of the State, which in Brazil and Spain are established by law.
