El Derecho a la Protección de datos, Regulación y aplicación en Europa y España

Abstract

[ES] La ultima revolución industrial, que ha ido de la mano de la tecnología, marcó un antes y un después en la forma en que la sociedad ha funcionado y que funciona desde su surgimiento, afectando a todos sus ámbitos. Cuestiones como el derecho a la intimidad y privacidad (Art. 18 CE) y (Art. 8 CEDH), vinculado al Derecho a la protección de datos de carácter personal a través del cual nos definimos como personas y como ciudadanos de un determinado Estado, son el punto de partida para esta investigación. En la tutela de estos derechos la Unión Europea ha sido pionera en la regulación y protección del Derecho fundamental a la Protección de datos de carácter personal que a partir del 25 de mayo de 2018, a través del Reglamento General de Protección de Datos (RGDP), lo regula, siendo plenamente aplicable en toda Europa.

[EN] The latest industrial revolution, which has gone hand in hand with technology, marked a before and after in the way in which society has functioned and has operated since its inception, affecting all areas. Issues such as the right to privacy and privacy (Art. 18 EC) and (Art. 8 ECHR), linked to the right to the protection of personal data through which we define ourselves as individuals and citizens of a given State, are the starting point for this investigation.

In the protection of these rights the European Union has been a pioneer in the regulation and protection of the fundamental right to the Protection of personal data that from 25 May 2018, through the General Data Protection Regulation (GDRGP), regulates it, being fully applicable throughout Europe.
