EL PRINCIPIO DE LEGALIDAD FORMAL Y MATERIAL EN EL RÉGIMEN DISCIPLINARIO DE LOS EMPLEADOS PÚBLICOS

Abstract

[ES] La potestad disciplinaria, que ejerce la Administración pública sobre el personal a su servicio no puede entenderse sin el cumplimiento del principio de legalidad, tanto en su vertiente formal como material, pues se trata este principio de un pilar fundamental en las relación de la Administración con sus empleados. En lo referente al régimen disciplinario, la vertiente formal del principio de legalidad, impone una reserva legal, no absoluta, en la que será la ley la que determine los elementos esenciales de la conducta antijurídica y la correspondiente sanción. Por otra parte, la vertiente material del principio de legalidad, no es más que la exigencia de que el tipo ilícito contenga una descripción clara y precisa, tanto de la acción u omisión ilícita como de las consecuencias de la misma, de manera que resulten relativamente predecibles para los ciudadanos, tanto la conducta ilícita como las consecuencias que se podrían derivar de la misma.

[EN] The disciplinary authority exercised by the Public Administration over the personnel at its service can not be understood without compliance with the principle of legalty, both in its formal aspect as material, because this principle is a fundamental pillar to the subjects attached to the Administration by an employment relationship.

In regards to the disciplinary regime, the formal aspect of legality principle imposes a legal reserve, not absolute, as we will analyze later. That will be the law which establishes and determines the essential elements of unlawful conduct, being able to attend an obligatory collaboration. On the other hand, the principle of typicality, or the material aspect of the principle of legality, is nothing more than the requirement that the ilicit type contains a clear and precise description, both the action or ilicit neglect and the consequences of it. In this way, the ilicit behavior and its consequences Will be relatively predictable for citizens in advance.
