DETENCIONES ILEGALES COMETIDAS POR FUNCIONARIOS PÚBLICOS

Abstract

La libertad individual, es considerada como uno de los derechos fundamentales del individuo, y ésta sólo puede verse afectada en los casos y en la forma previstos por la ley y teniendo en cuenta que en su ejecución o desarrollo no se vulneren garantías constitucionales o legales que amparan a quien se ve privado de ella. El objeto de este trabajo se centrará en el análisis de los tipos previstos en los art. 167 y 530 del Código Penal en relación a las detenciones ilegales cometidas por funcionarios públicos y se analizará cuestiones polémicas en relación al estudio, interpretación y aplicación de las diversas modalidades típicas de detenciones ilegales que pueden ser cometidas por autoridad o funcionario público. Individual liberty, is considered as one of the fundamental rights of the person ,and this can only be affected in the cases and in the way provided by law and taking into account that its execution or development does not violate constitutional or legal guarantees, which protect who is deprived of it.

The objective of this work will focus on the analysis of the types provided for in art. 167 and 530 of the Penal Code in relation to illegal detentions committed by public officials and controversial issues will be analyzed in relation to the study, interpretation and application of the various typical modalities of illegal detentions that can be committed by the authority or public official.
