Contratación temporal en España

Abstract

[ES]En España existe un problema histórico de altas tasas de temporalidad y dualidad en el mercado de trabajo esto es debido a que los contratos más utilizados, en la práctica, son los contratos temporales de obra y servicio determinado y eventual por circunstancias del mercado. Esto sucede aunque la normativa laboral pretenda favorecer la estabilidad en el empleo con mecanismos que dan preferencia a la contratación indefinida. Por último, en España la contratación en fraude de ley es totalmente otro factor más a analizar por la legislación laboral y su debido exceso que las empresas utilizan de esta materia. A lo largo del tiempo la legislación laboral se ha sometido a distintas reformas pero hasta la fecha, no han conseguido reducir el problema de la temporalidad ni tan siquiera equilibrar las tasas de contratación indefinida y temporal.

[EN]In Spain there is a historical problem of high rates of temporality and duality in the labor market, this is because the most used contracts, in practice, are temporary contracts for work and service determined and contingent by market circumstances. This happens even if the labor regulations pretend to favor the stability in the employment with mechanisms that give preference to the indefinite contracting. Finally, in Spain, the recruitment in fraud of law is totally another factor to analyze by the labor legislation and its due excess that the companies use of this matter. Over time the labor legislation has undergone different reforms but to date have failed to reduce the problem of temporality or even to balance the rates of indefinite and temporary employment.
